Boone Prosecutor Issues Statement On Judges Decision

On May 20, 2026, Roy Matthew Lee was arrested in Boone County following a SWAT response and standoff. After his arrest, Mr. Lee was charged with six felony offenses, including:
Attempted Murder (Level 1 Felony)
Criminal Confinement (Level 3 Felony)
Criminal Confinement (Level 5 Felony)
Domestic Battery Resulting in Moderate Bodily Injury (Level 6 Felony)
Intimidation (Level 6 Felony)
Strangulation (Level 6 Felony)
Monday, a bond hearing was held in Boone Circuit Court before Senior Judge John G. Baker. Both the State and the Defense were given the opportunity to present evidence and argument regarding the appropriate conditions of release. Following the hearing, the Court ordered the defendant released on his own recognizance into the custody of his sister, subject to specific supervisory conditions. The Boone County Prosecutor’s Office respects the role of the judiciary and the importance of judicial independence within our criminal justice system. However, we strongly and respectfully disagree with the Court’s decision in this case. During the hearing, the State presented substantial and compelling evidence demonstrating that the defendant poses a serious danger to the victim and to the community. Given the violent nature of the allegations—including attempted murder—
and the circumstances surrounding the defendant’s arrest, the State advocated for a significant monetary bond accompanied by strict conditions to ensure public safety.
While the Court imposed certain restrictions requiring the defendant to remain under supervision and limiting his movements, the State does not believe those conditions sufficiently mitigate the risks that were identified. Additionally, placing a family member in the position of supervising a defendant charged with such serious and violent offenses creates significant concern. It is not appropriate to place that level of responsibility on a private individual who is not trained or equipped to ensure compliance with court-ordered conditions or to effectively manage the risks presented.
Our office believes it is essential that the community be informed of decisions that directly affect public safety. Transparency remains a priority, and we want the public to understand both the Court’s ruling and the State’s concerns regarding the potential danger posed by the defendant’s release.
The Boone County Prosecutor’s Office will continue to advocate vigorously for the safety of victims and the protection of the public at every stage of this case.
